Terms & Conditions (Nagelati AU)
Welcome to Nagelati AU (the “Website”). These Terms & Conditions apply to:

your access to and use of this Website; and

any orders placed by you for products sold via this Website.
By using this Website or placing an order, you agree to these Terms & Conditions.

2. Definitions

ACL means the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

Business Day means a day that is not a Saturday, Sunday or public holiday in New South Wales, Australia.

Order means an order you place through the Website.

Products means the goods sold on the Website (e.g., vegan press-on nails and accessories).

Accepted Order means an Order that we have confirmed by email and for which payment has been successfully processed.

Returns Policy means our Returns & Refunds Policy published on the Website (and incorporated into these Terms).
3. Eligibility & account information
3.1 You must be 18 years or older to place an Order.
3.2 You agree that all information you provide (name, address, email, phone) is accurate and up to date.
3.3 You are responsible for ensuring your delivery address is correct. If an address is incorrect, you may be charged for re-shipping.
4. Website information & product presentation
4.1 Product photos and descriptions are provided as accurately as reasonably possible. However, colours may vary due to screen settings and lighting.
4.2 Any application, wear-time or durability information is indicative only and can vary based on nail preparation, nail type and daily activities.
4.3 We may update product information, availability and prices at any time.
5. Orders (how contracts are formed)
5.1 Placing an Order constitutes an offer by you to purchase Products under these Terms.
5.2 We may accept or reject any Order at our discretion (including where stock is unavailable, payment fails, fraud is suspected, or an obvious pricing/description error occurred).
5.3 An Order becomes binding only when we send you an order confirmation email (Accepted Order).
5.4 Orders placed on weekends or public holidays may be processed on the next Business Day.
6. Pricing, GST & payments
6.1 Prices are shown in AUD unless stated otherwise.
6.2 GST: Prices are [inclusive of GST / inclusive where applicable] for Australian deliveries. If GST is not payable for an international order, GST may be removed at checkout where applicable.
6.3 Delivery fees (if any) are shown at checkout and are additional to product prices unless explicitly stated otherwise.
6.4 You must pay using the payment methods available at checkout. Payments are processed by third-party providers. We are not responsible for unauthorised use of your payment method.
6.5 If a payment is reversed, charged back or fails, we may cancel the Order and/or refuse future Orders.
7. Promotions & discount codes
7.1 Promo codes cannot usually be combined unless we state otherwise.
7.2 We may modify or withdraw promotions at any time.
7.3 If a promo code is used in error or contrary to the rules, we may cancel the Order or adjust pricing to the correct amount (subject to ACL).
8. Shipping & delivery
8.1 Delivery timeframes are estimates only and not guaranteed. Delays may occur due to carriers, peak periods, weather or other factors outside our control.
8.2 Risk passes to you when the Products are delivered to the address you provided (or when the carrier marks the delivery as delivered, including “safe drop” where selected/authorised).
8.3 If you provide authority to leave (“ATL”) or delivery instructions, you accept the risk once delivered per those instructions.
8.4 If a parcel is returned to us due to non-collection, incorrect address, or failed delivery attempts, we may deduct any return fees and handling costs from any refund (see Returns Policy).
9. International orders, duties & taxes
9.1 For deliveries outside Australia, you are the “importer” and are responsible for any duties, taxes, tariffs or customs fees charged by your country.
9.2 We do not guarantee that international shipments will clear customs. Any delays caused by customs are outside our control.
9.3 We may provide shipment information to carriers and customs where required (name, address, product description and value).
10. Cancellations & changes
10.1 You may request cancellation only before we dispatch your Order.
10.2 If your Order has already been dispatched, it cannot be cancelled.
10.3 We may charge a reasonable cancellation/processing fee for cancellations approved after processing has started [OPTIONAL: insert fee or remove clause].
10.4 Nothing in this clause limits your rights under the ACL.
11. Returns & refunds (change of mind + hygiene)
11.1 Our Returns Policy forms part of these Terms. Please read it carefully.
11.2 Change of mind: We do not offer refunds for change of mind unless we explicitly state otherwise.
11.3 Hygiene: Due to health and hygiene, press-on nails and cosmetic items cannot be returned if packaging has been opened, damaged, used, applied or altered (except where required under the ACL).
12. Australian Consumer Law (ACL)
12.1 Our goods come with consumer guarantees that cannot be excluded under the ACL.
12.2 You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
13. Warranties & limitations (to the extent permitted)
13.1 To the extent permitted by law, we exclude all other warranties not expressly stated in these Terms.
13.2 Nothing in these Terms excludes, restricts or modifies any rights you have under the ACL or other applicable laws.
13.3 To the extent permitted by law, our liability for breach of a consumer guarantee may be limited (at our option) to replacement, repair, or refund of the price paid for the affected Product.
14. Liability
14.1 To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of opportunity or loss of goodwill.
14.2 Our total liability arising out of or in connection with an Order is limited to the amount paid by you for that Order, except where the ACL requires otherwise.
15. Intellectual property
15.1 All content on this Website (text, images, branding, product photos, designs, logos) is owned by or licensed to us.
15.2 You must not copy, reproduce, distribute, scrape, or commercially exploit Website content without our written permission.
16. Acceptable use
You must not:

misuse the Website (e.g., hacking, scraping, introducing malware)

interfere with Website security or functionality

use Website content for competing commercial purposes
We may restrict or block access where misuse is suspected.
17. Privacy
Our Privacy Policy explains how we collect, use and disclose personal information. By using the Website or placing an Order, you consent to our handling of your personal information as described in the Privacy Policy.
18. Changes to these Terms
We may update these Terms from time to time. The version published on the Website at the time you place your Order applies to that Order.
19. Governing law & disputes
19.1 These Terms are governed by the laws of New South Wales, Australia.
19.2 The parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
19.3 If a dispute arises, both parties agree to first attempt to resolve it by good-faith negotiation for at least 14 days before commencing court proceedings (except for urgent injunctive relief).
